Today in Tulsa County small claims court, we won a $3,900 judgment plus costs for my client — and we're coming back for attorney fees.
Here's what happened: a massive limb from a neighbor's tree came crashing down on my client's garage. Not the first time. Not the second time. The third time.
This wasn't an act of nature — it was neglect. The tree was damaged, diseased, and dying. My client had warned the owner before, but instead of fixing the problem, the only response he got was the finger.
In Oklahoma, you're not liable for every fallen limb… but if you know your tree is dangerous and ignore it, you're on the hook. We proved the owner knew — with photos, records, and a history of prior incidents. The judge agreed and ordered full reimbursement for the cost of removal.
Bottom line? Neglect has consequences. If someone else's property is damaging yours, you don't have to keep paying for it.
